    I have EAD for couple of years & when I moved to Ohio, I was issued 4 years DL. They did look at I-94 (I travelled on AP having one year validaty on I-94), also they DID NOT looked at my EAD expiry date..They asked very simple question - Do you have your SSN? Thats it..!

    C'mon...Guys, come to Ohio..you will get DL for 4 years..

    My Ohio license will expire soon along with H1B. As far as my attorney says, when the original H1B application receipt presented, BMV issues one-year renewal. With the H1B approval, they renew the license for three years.

    Can I ask you a question? How much your corp usually pays if you are billing at $80 per hour? 55k per year or 95k per year as Salary + Benefits. (BTW - Just to make things clear, I am not looking for job as I am independent IT consultant with my own corp).

    I have seen many cases where consultant is billed at 80-90 per hours and gets paid only 50 to 60k (based on his/her "negotiation" power).

    In one case, this agency had two consultants at same client (one of the large banks) and were getting billed at $80 per hour. The H1-B person was getting 56k/year and green card holder was making 95k per year. This is the reason why many people want to jump for another job when they have EAD or GC.

    Hi Friends,

    I am a permanent employee for "x" company, my 140 filed on May 1,2007 waiting for approval, 485 filed on August 22,2007 not been approved either, we just got our EAD's, also please note that i am on 6th year extension on h1... my company "x" moving all projects to the different company "y" from December 1, 2007. ie we are all moving to "y" with the same job title just everything is same istead of "x" it is now "y" company.

    When i called my legal department and ask them about green card status they simply said nothing to worry... everything will be moved to "y" company, as a transition exployees..

    Be honest with you guys...from the last 4 days... i could not sleep... i really dont know what to do in this situation, this is the reason.. i am seeking your help. can some one guide me or answer below questions please.

    1. 140 filed 05/01/2007 - 11/30/2007 more than 180 days with "X" company
    2. 485 filed 08/22/2007 - 11/30/2007 more than 90 days with "x" company
    3. EAD approved
    4. Travel documents approved
    5. I am on H1 6th year extension.
    6. Transition employee.

    my question is

    1 Can my green card status remains the same and continue the process with the new "y" company ?

    2.Do "y" company has to start processing labour/140 again ??

    3.Is it doable that moving everything from "x" to "y" including GC processings ??

    Thanks in advance...Kindly help me out in this situation like how to proceed from here

    Hi I am in similar situation, My I 140 is approved from company X in June and I applied I485 and EAD in July (receipt is pending). I am on 8th year of H1. My HR said not to worry about anything everything (H1 and GC) will be taken care of by new company (company Y). My Question is-

    Do I need to worry since I will be employee of new company by this month end (less than 180 days of I 485 filing).
    Do 180 days limit still valid from July?
    If I change job (to company Z) after 180 days from July on EAD will it affect my GC? How?

    Please help

    It makes no difference whether they allow concurrent filing of 140/485 or not IF YOUR EMPLOYER IS WILLING to pay extra premium processing for 140. IF not , it makes minimal difference (2-3 months delay). Earlier this year, people were getting 140 approved on 6-8 weeks on average without premium fee.

    If your date is not current:
    This rule makes 0 difference. File 140 and wait for approval while your date moves forward. Once its current, file 485. So everyone who is retrogressed, this rule makes no difference to you 485 filing and getting EAD/AP.

    If your date is current: File 140, regular processing 2-3 months and then file 485. If you can get premium processing done then it would be 15 days and then file 485. Either ways, you are delay in filing 485 by 2-3 months. In the grand scheme of things, its negligible. It would take even 2 months for your lawyer to get the paperwork straight for filing 485.

    So please relax, this new rule that does not allow concurrent filing of 485 and 140 is not earth-shattering. Its a revenue generation move. And its good as long as revenue stays in USCIS as they do need revenue to hire more people to process files faster, which is in our own benefit. The only problem we have is the rise in fees generates revenue which often times does not stay with USCIS and goes away to other agencies of DHS(I think, this was mentioned in CIS Ombudsman report, if I am not wrong).

    SO if USCIS wants to make a new rule of filing I485 for the one whose I 140 is cleared and priority date is not current, It CAN DO That RULE Right?
    We do not need any Congress approval for that Right?
    If so can we explore this option??

    I am already actively participating in all the event for "Filing 485 when PD is not current" in immigarationvoice ...

    I sent my contribution amount for IV's April month washington campaign also ...

    I understand 221g is an action to prevent fraud. But at the same time consular officer should give a chance to prove visa applicant's point at the time of interview. In my case I had most of the docs at the time of interview, Why don't they accept those docs and start processing immediately, then I would have saved some 3 weeks ...

    Moreover, Not all ther employer will hold your position, If your case is taken long period for approval. They have to run their business ...

    So I would expect DOS should change the way of handling 221g cases. Right now It's too lenghty and more confused ...
    It is hard to say dont loose hope but really thats the best option possible anyways. Is your family also affected or are they back here in the US? Your son is in which grade? If he is back with you in India it might be best to inform his school about the delay. Hopefully you will hear great news soon so keep the faith. Best..

    - You are a dependent EAD holder
    AND
    - You will never need to travel outside US
    AND
    - Some one else takes care of renewing your EAD every year
    AND
    - Someone else pays the $340 + $200 (lawyer fees) to renew the EAD
    AND
    - The principal applicant is able to find job in "same or similar" if laid off so that I-485 is not jeopardized
    AND
    - You are never going to get laid off because if you are, then good luck, because there are lots of companies out there that explicitly require green card holders and citizens because they don't want to get into any type of immigration issues (illegal by law, so you can technically file lawsuit against them).

    AND
    - You will never apply for US citizenship
    AND
    - You children won't need tuition or resident rates when they go to college

    Did you mean for EB3 ROW? One year? I am not so sure. Couple of months maybe... Oh i wasn't being specific if ROW or India or china... just threw a year in there, since 47K seems like a lot of approvals at one go.

    Some one pointed out in another thread, that the USCIS FAQ mentioned that only a 'subset' of the potential 47k cases have namecheck pending for more than 180 days. So may be not all of the 47k cases (even those with current PDs) may be eligible to qualify under 180 day FBI namecheck auto approval rule. Thus not all 47k cases will be approved by the mid March deadline that USCIS mentioned.

    yeah i read that aswell... as usual even that little light that sometimes seems to shine... all of a sudden seems quite dim.

    FYI USCIS retracted the FAQ posted on the 19th, so we will have to wait and see if it's gonna be any good news on this subject.

    Does that mean I am screwed? My package got delivered this AM at Mesquite, TX as per the tracking receipt.

    I am in the same Boat. My PD is May 26 2004. Mine and my wife's case was transffered to Des Moines Iowa on March 19th 2008 and says its for additional processing. I applied for EAD renewal on June 11th and no approvals yet. I called uscis and they say that my ead would not be approved until the additional processing on my 485 is completed.. I am guessing it would be an interview.

    I am also in same situation. Two 140s (eb2 and 3) both have same PD. Have beed trying for interfile from last one year. I do not know if my case is eb2 or still in eb3. I enquired from Congressman and she told me that my case is assigned to a IO on 6th Aug so its in eb2. She is not listening to anything else after telling me this information. I have infopass on 2nd Sep. lets see ...

    I have changed jobs recently using EAD after over 180 days of filing 485 and 140 approval. Process is pretty simple if you do not wish to notify USCIS like me. Just fill out a I-9 form with EAD details with your new employer and give them a copy of the card (front and back) and with passport copies. Job title and description do not match completely with the LCA. Employer will help with employment verification letter with salary/title/responsibilties if and when a RFE is received.
