Does anyone know if EAD renewal requires an employment at the time of renewal? My I140 have been approved and I485 pending for long time under EB2-NIW. Also, do I loose legal status to stay in USA if I lost employment while my I485 pending. Again, my GC application is not company sponsored, it was all by myself. Do I stay in right status even I become unemployed while my I485 pending. My I485 will be pending for few more years due to retrogession. So I am wondering if I can stay as unemployed for a period of time while my AOS pending.
Also, do I need to have an employment while re-entering using AP? I recently used my EP to re-enter but no question was asked about employment. I am thinking if I can use AP for re-entry if I travel outside while I am unemployed. I have to think about all this options as chaotic situation is going on the company and layoff might be inevitable.

Am currently on F1 - OPT status (stem OPT). Been working as a volunteer intern for past few months. Currently one of start-up company is interested in hiring me but they do not have a legal department and also not enough resources to apply for H1B. I offered to pay for my H1B fees, but they have no idea how to go about this.
Can anyone please tell how do i go about this? What kind of lawyer should i approach , what information will i need from the company, how much money does all this involve.
The other option is start working for this company , get H1 done through a consultant and transfer the H1b, again this involves legal dept which neither me nor the company has any idea. Please advise .
My OPT is valid until Dec 2011.

The big news is that the masters cap was hit as of December 24th. I had been predicting since last summer that this 20,000 quota would be hit in the last week of the year and the pace of usage stayed extremely consistent. According to the mathew ohio website. there is apparently a very hot legal battle going on between the DHS and a happless immigrant who had been arested for out of status presence. The immigrant was on an H1b and had filed an application in a timely manner and was awaiting decision on his application when the DHS official arrested him and tried to deport him. Please post more information on this issue if anybody is aware of it. His I-94 expired, however, his petition for H1b extension was pending!!!!:o:o:o

I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?

I am in my 10th year of H1B visa. (GC in process). Every other time I went to INDIA , I got my stamping in INDIA except in 2009 when I returned on Advanced Parole because of a lack of time. Now I need to go to INDIA again in July and I observed this condition for visa stamping at INDIAN consulates which is :
Have the same class of U.S. visa which is still valid or that has expired less than 12 months from the scheduled date of interview.
Wish to apply for the same visa class (e.g. had an H1 work visa, now applying again for an H1 work visa)
My question is whether my last entry to US on Advanced Parole will be interpreted as not having the same class of VISA. After I entered on AP , I did renew my H1 Visa and it is valid upto April'2011.

I am Cross Charging and applying for AOS filing. While filing do I need to provide BONA FIDE copies of Marriage & Birth certifcates. ??
Its mentioned in the application right? You need to provide certified copies of marraige and birth certificates matching your application

Dear All,
As I work for a consulting company and my previous lawyer was my employer's ass kisser, I decided to go for a new lawyer.
(1) Will the new lawyer need any documents from old lawyer? As such I have copies of everything till now
(2) My employer is in Dallas and I am on a project in New Jersey, but my petition is for my permanant work location in Dallas - is it advisable to choose a lawyer from Dallas (future employment area) or NYC/NJ where I currently have my project (i plan to stay here for a while) - what is the general take - physical accessibility to lawyer or choose lawyer close to company location?
(3) How hard is it to find lawyers? Last month when dates moved considerably - I heard lawyers have been stressed and over burdened over the mad rush of petitions and have been least responsive - will lawyers take new cases in such situations???
(4) Can anyone suggest a communicative lawyer? The best of all :)
