    Due to the economic downturn there aren't many companies sponsoring GCs for employees. I doubt it would be more than 20 to 30k per year from now. This leaves 100-110k visas available every year for retrogressed countries like india and china

    if there 300-400k pending GC applications in all categories then shouldn't all of us get our GC in next 3-4 years?

    I thought there was a country limit on how many gcs are approved for a country per year. So even if there is a spill over - can a backlogged country like India use it because of the limit ?

    Vayalar Ravi will know more about Indians in Gulf. He is form Kerala and his main focus is Indians in Gulf coutnries. While I dont mean say he is partial to them or any such thing, I think he will understan those issues better than ours.


    No harm in trying. Not sure if we will get anything out of it.
    It may be worthwhile to talk to an IAS officer accompnaying him rather than the minister himself.

    I agree .. this should be tried. I do not know heard about this minister before,
    my apologies but by title of Ministry he seems to be a appropriate to apprach
    for help.

    Is it too much to ask Google to put a Diwali logo like it does for Hanukkah or Christmas .. at least if not in google.com but in google.co.in?

    Also is it too much to expect American mainstream media to totally NOT ignore Diwali which has significance for the second largest population in the world and instead publish significantly less significant story of the balloon boy?

    Is it too much to ask for to include Diwali in the spell check for this editor? (Not wailing or Gwalior ...)

    It is this mentality of deliberately ignoring the feeling of majority of the world population that is getting the western civilization more and more isolated and retracted.

    Well it doesn't really matter. And I am visiting India now and I can see that this country and China will definitely kick ass of Western civilization .. as it is already doing. The people here are hungry for more and in spite of seemingly unsurmountable problems it will succeed and once again India will be the "Sone Ke Chiriya".

    I have strong belief on your postings. Don’t know about Berkleybee…
    I am from India EB3. I strongly believe that we can change this system, after all it is human made, outdated and obviously not suitable for current scenario.

    So realistically what we can do about this, if so what would be the approach.
    I am relatively new to the forum and what have posted and debated by UN (Iimmigration poratl also), make sense and i believe we should not be watching visa bulletin so eagarly , contrary we should be watching what is happening the reform front.

    Then he cannot continue after his current H1-B expires (After 0 to 3 years)?
    Going back to his home country is the only option?

    That is correct unless you have other grounds for new H1b petition (highly unlikely at this point in one's stage) - Per Yates as well as Neufeld memo,

    If at any time before or after the filing of the single (combined) extension request a final decision is made on the above-stated grounds, the beneficiary of the extension request will not be entitled to an extension beyond the time remaining on his or her 6-year maximum stay unless another basis for exceeding the maximum applies.

    Folks. I am planning for India vacation this winter.
    I have a quick question. Please let me know your opinions.

    My H1B stamp expired a few yrs back. I have an approved I797 valid till April 2008. Can I travel on this AP and come back and be on H1B? Do I have to use EAD(once I come back from India) if I use AP?

    I applied for my EAD renewal during last week of Nov 2010, it took only 42 days to receive my renewed card. It got 2 years validity, validity starts from the next day of current EAD expiration date. Even though current card is valid for another 2 months, pleasantly surprised to receive the new card in USPS priority mail. Overall, job well done by USCIS as for as this EAD renewal in concerned.

    My priority date is Jan 2007, not sure whether by extending it for 2 years USCIS is not expecting me to be current in the near future. Personally I am expecting to be current during this July - Sep time frame. Worst case at least it should be a touch and go scenario, fingers crossed.

    They should also allow people from Backlog Centre (PD 2001-MARCH 2005) to file 485. Looks like they really cant make any impact. How many more years to wait just to file 485 ? Oh Gosh....

    Come August, all dates will be current again and you should be able to adjust.

    Update:
    The Doctor admitted his mistake.
    He completely forgot to mark the TB test earlier.
    He was ready to back date to avoid more inconveniance to me.
    But I told him to be sincere in all aspects.
    I basically forced him to give my wife a TB test again and also the x-ray.
    Now the plan is to submit all this information with a nice letter which states that the doctor had forgotten things last time etc etc.
    Hopefully they will mark the case as - resume processing.

    Wow.. I don't understand why we always make a big fuss of such things. Do we think that we are so special or we are just too sensitive because of our inferiority complex. Invent something that will change the world for better, win some gold medals in Olympics, improve the quality people by building better infrastructure, innovate and accomplish and the world will automatically notice. And yes, don't be an hypocrite, go back and do something good if you truly believe in it. Change starts within and courage to accept one's weakness leads to strength. Patting yourselves in the back for the achievement made so far only bring complacency and my friend we have a long way to go!

    When money is in excess of $10,000, there are several applicable rules.

    I vaguely remember a discussion several months ago on the forum about people that have gone back to their home countries after having waited for their green cards.

    We have a media interview opportunity and need to find such examples. I remember an instance about a person going back to Bombay after he had immigration issues. He had set up his company there. Such people who could have helped US economy and growth will make a compelling story.

    Pls. let me know urgently of any such cases and I will follow it up. This is required today and we have a short time window.

    Two of my colleagues went back to India after facing GC hurdles. Among the two one is Phd in Atomic Science and Computer Science and lead a group of people and another is a Project Leader.

    In the first one's case it took more than 4 years for him to clear his labor and got frustrated by this process. He initially sent his family back to home because of uncertainty. That created more hurdles for him as well as his family could not able to get AP in time and he is nearing completion of his 6 year H1 as well. Eventually he decided to pack his bag and went back to his home country, setup a big business and now visiting US on business Visa and take some of the jobs from here to there :)

    [Side note: His approved LC remains unused at the company end even now, but finding a suitable person seems to be an uphill task for the Management and HR]

    In the second one's case his labor took almost 5 years to clear and having frustrated, he decided to go back as well. He does not want hang in a place where a decision cannot be given in a timely manner. He got some special technical skills and his roll is now being replaced by 2 people. He also went back to his home country, joined a big IT firm as a Director and getting more jobs to be outsourced there :)

    In both the cases, US is a clear looser by not taking advantage of the skill sets they have.

    I am in a similar situation. My lawyer prepared the following letter which seems much simpler than what you had mentioned. I hope, its helpful. However, my company HR is not willing to even sign on this one. they omitted the word 'permanent' and also, removed the last sentence mentioning that i will continue as full time employee after receiving the green card. I regret joining a big company now. But, we are where we are and have to deal with it.
